1. Agreement
By using the VORTEXORCE platform ("Service"), operated by VORTEXORCE Ltd ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
VORTEXORCE is a staffing and workforce management platform that connects workers with client companies for temporary and contract work. The Service includes job matching, shift management, timesheet tracking, invoicing, and payroll processing.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to use the Service.
- You must have the legal right to work in the United Kingdom.
4. Worker Obligations
- Arrive on time for assigned shifts and complete work as agreed.
- Maintain valid right-to-work documentation.
- Accurately record working hours using the platform's check-in/check-out system.
- Comply with client site rules and health and safety requirements.
- Notify us promptly if you cannot attend a scheduled shift.
5. Client Obligations
- Provide a safe working environment for all workers.
- Approve timesheets promptly and accurately.
- Pay invoices within the agreed payment terms.
- Not directly engage workers placed through our platform outside of the Service without prior agreement.
6. Payments and Fees
- Workers are paid for approved hours at the agreed rate.
- PAYE workers receive gross pay plus holiday pay accrual. Employer NI and pension contributions are handled by us.
- Self-employed workers invoice for their hours and are responsible for their own tax obligations.
- Client fees are based on subscription tier and include per-hour agency fees as outlined in the pricing schedule.
- Cancellation fees may apply for shifts cancelled within 48 hours of start time.
7. Intellectual Property
All content, features, and functionality of the Service are owned by VORTEXORCE Ltd and are protected by copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by law, VORTEXORCE Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the fees paid by you in the preceding 12 months.
9. Termination
We may suspend or terminate your account at any time for violation of these terms. You may close your account at any time by contacting us. Outstanding payment obligations survive termination.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
