2.What this notice covers
This notice covers what happens when you visit the public Vortexorce website, browse advertised vacancies, use a contact or enquiry form, subscribe to job alerts, or begin registering as a worker or a hirer.
Once you register it stops being the notice that applies to you, and one of these takes over:
- if you register as a work-seeker, our Agency Worker Privacy Notice;
- if you register on behalf of a business, or are given a Portal login, our Hirer and Business Contact Privacy Notice.
Our Cookies Policy explains the cookies and similar technologies we use, and how to change your choices.
3.Who the website is for
The website and the Platform are intended for people aged 18 or over. We do not knowingly register anyone under 18, and we do not knowingly collect personal data from children. If you believe a child has given us personal data, tell us using the details in section 1 and we will delete it.
4.The data we collect
Data you give us
| Where | What we collect | Whether you have to give it |
|---|---|---|
| Contact and enquiry forms | Your name, email address, telephone number, the organisation you represent if any, and whatever you write in the message | You choose what to send us, but we cannot reply without contact details |
| Job alerts and saved searches | Email address, the roles, sectors and locations you are interested in, and your search radius | Optional |
| Starting a worker registration | Name, contact details, location, the sectors you want to work in, and the credentials you say you hold | Necessary to register. If you do not complete registration we delete what you started (see section 8) |
| Starting a hirer registration | Your name, work contact details, the organisation, its registration number and address | Necessary to register |
| Buying advertising or a subscription | Billing details and the transaction record. Card details go directly to our payment provider and we never see or store them | Necessary to complete the purchase |
Data we collect automatically
| What | Detail |
|---|---|
| Technical and log data | IP address, browser type and version, operating system, device type, time zone setting, the pages you visited, the time and duration of the visit, referring and exit pages, and errors |
| Cookie and similar data | As described in the Cookies Policy. We set non-essential cookies only if you agree |
| App data, if you use the Vortexorce app | Device identifier, app version, crash reports and diagnostic data |
We do not collect location data from the public website. Location data is only collected once you are a registered worker scanning in and out of a shift, and the Agency Worker Privacy Notice explains exactly what is recorded.
5.Why we use it, and our legal basis
| What we do | Our legal basis |
|---|---|
| Show you the website, keep it working and keep it secure | Our legitimate interests in running a functioning and secure website |
| Reply to your enquiry | Our legitimate interests in responding to people who contact us. Where the enquiry is a step towards a contract, taking steps at your request before entering into one |
| Publish and distribute vacancy advertisements and show you search results | Our legitimate interests in operating the Platform, and compliance with our obligations under the Conduct Regulations as to what an advertisement must say |
| Send you job alerts you have asked for | Your consent, which you may withdraw at any time |
| Send marketing about our services to business contacts | Our legitimate interests in promoting our business, subject to section 6 |
| Process a payment for advertising or a subscription | Performance of our contract with you or your organisation |
| Measure how the website is used, and improve it | Your consent, given through the cookie banner, for analytics cookies |
| Detect and prevent fraud, abuse, scraping and attacks | Our legitimate interests in protecting the Platform, our workers and our clients |
| Comply with the law and respond to regulators | Compliance with our legal obligations |
We do not use your consent as a general basis for the processing above. Where we do rely on consent, which is for job alerts and for non-essential cookies, you can withdraw it at any time and it is as easy to withdraw as it was to give.
6.Marketing and job alerts
If you subscribe to job alerts we will email you about vacancies matching what you asked for. Every alert carries an unsubscribe link and you can stop them at any time, either through the link or by contacting us.
If you give us your details in the course of enquiring about or buying our services, we may email you about similar services. You can opt out when you give us your details and in every message afterwards. We do not sell or rent your details to anyone else for marketing, and we do not send you other organisations’ marketing.
We never charge a work-seeker for finding work or for access to the Platform, and we will never ask you for payment for those things. If you receive a message appearing to come from us that asks for payment in return for work, it is not from us: please report it to us at once.
8.How long we keep it
| Record | How long |
|---|---|
| Enquiries and the correspondence that follows | 2 years from the last contact |
| Incomplete registrations | 6 months, then deleted |
| Job alert subscriptions | Until you unsubscribe, and then only the record that you unsubscribed |
| Marketing suppression records | Indefinitely, so that we do not contact you again by mistake |
| Website logs and security records | 12 months |
| Analytics data | As stated in the Cookies Policy |
| Transaction records for advertising and subscriptions | 6 years from the end of the relevant tax year |
Once you complete a registration, the retention periods in the Agency Worker Privacy Notice or the Hirer and Business Contact Privacy Notice apply instead.
9.Sending data outside the United Kingdom
Some of the providers listed in section 7 may store or access data outside the United Kingdom. Where that happens we rely on adequacy regulations, the International Data Transfer Agreement or the UK Addendum to the EU standard contractual clauses, and we carry out a transfer risk assessment first. Ask us and we will tell you which provider and which mechanism.
10.Your rights
You have the rights of access, rectification, erasure, restriction, objection and portability, the right to withdraw consent where we rely on it, the right to object to direct marketing at any time, the right not to be subject to a solely automated decision with a legal or similarly significant effect, and the right to complain to the Information Commissioner.
Exercising a right costs you nothing. Contact us using the details in section 1 and we will reply within one month. For a complex or repeated request we may take up to two further months, and we will tell you within the first month if we need to and explain why. We may ask you to confirm who you are. The only circumstances in which we may charge are for further copies of the same information, or where a request is manifestly unfounded or excessive, and we will explain any charge before making it.
To complain: Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF; telephone 0303 123 1113; ico.org.uk. We would rather you came to us first so that we can put things right, but you do not have to.
